1) These Terms and Conditions:

a) You should read these terms and conditions carefully before using this web site (the "Site"). By accessing and using the Site you agree to be bound by the terms and conditions set out below. If you do not wish to be bound by these terms and conditions, you may not access or use the Site.

b) These Terms and Conditions may be updated from time to time. At least thirty days prior to any material change, we will notify you by e-mail, at the address you have provided, of the new or different terms and conditions or provide you with a hyperlink to such new or different terms and conditions on the Site. Any such notice will be deemed received when made available to you at the address you have provided. If you continue to use the Site after the effective date of such notice, your continued use of the Site constitutes acceptance of the changes and an agreement to be bound by this agreement, as amended. If you do not agree to the changes, you agree to discontinue your use of the Site

In any event information posted on or downloaded from this Site is general in nature, for information purposes only and not intended to constitute advice in any specific situation. 3) Site Access:

STRATREAL reserves the right to suspend and withdraw access to some or all of the pages of the Site without notice at any time and accepts no responsibility for these pages not being available. STRATREAL does not warrant

(3) that the Site or the server that makes it available is free of viruses or bugs.

a) Where STRATREAL provides hypertext links to other web sites or contacts, STRATREAL does so for information only and such links do not constitute an endorsement or recommendation by STRATREAL of any products or services in such sites. You use such links entirely at your own risk and STRATREAL accepts no responsibility for the content or use of such web sites or for the information contained on such sites.

5) Copyright and Use of Content:

a) You acknowledge and agree that, unless otherwise stated, all rights, including copyright, database rights and other intellectual property rights, in the Site and its contents, including logos, graphics, underlying source codes and software, are owned by (or licensed to) STRATREAL or otherwise used by STRATREAL as permitted by applicable law.

b) In accessing the Site, you agree that you will access the contents solely for your own private use or internal use within your employer's organisation, but not for any commercial or public use or other exploitation. You can download and use the service on a single CPU at a time and you can print out a single hard copy of any part of the content on the Site for your personal use.

c) Except as hereby permitted, you undertake not to copy, store in any medium (including in any other website), distribute, transmit, re-transmit, broadcast, modify or show in public any part of the Site or its content without STRATREAL's prior written permission or in accordance with the Copyright, Designs and Patents Act 1988.

d) You will not remove any copyright or trade mark notice appearing on any copies of Site contents made under these terms and conditions.

6) Trade Marks:

a) "STRATEGIC REAL ESTATE ADVISORS","STRATREAL", "SREAL", "GROW" and associated logos and devices are trade marks of STRATREAL in the territories in which it does business. STRATREAL may also claim trade mark and service mark rights in other marks contained within the pages of the Site.

b) Other trade marks and names may be used within the pages of the Site to refer to the entities claiming the marks and names or their products. STRATREAL disclaims any proprietary interest in the marks and names of others.

7) Use of the Site:

a) You agree to use the Site in accordance with these Terms and Conditions and only for lawful purposes and in a manner, which does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Site by any third party. You agree not to import or transfer to the Site either directly or indirectly any information or other content which is or may be inaccurate, misleading, defamatory, obscene or offensive or in breach of any intellectual property right or similar right or damaging to the software or performance of the Site.

b) No right or licence, implied or otherwise, to use the Site or its Contents is granted other than as expressly set out in these Terms and Conditions.

8) Scope of Your Responsibilities: You are wholly responsible for the use of the Site by any person using your terminal or point of presence and are responsible for ensuring that any such person also fully complies with these terms and conditions.

9) Your Breach: If you are in breach of these terms and conditions you agree to indemnify STRATREAL in respect of any and all losses, costs or damages including reasonable legal fees incurred by STRATREAL in relation to or arising out of such breach.

10) Forum and Message Board: From time to time STRATREAL may offer you and other interested parties a forum and message board where you can exchange ideas and comments on any matter to do with the Site. If you wish to use such a forum and message board then you must abide by the following rules. You must not misrepresent your name or your affiliation. You may use nicknames as long as you do not pretend to be someone you are not. You must not use the forum and message board to send messages of an obscene, offensive, pornographic, fallacious or fraudulent nature, or that are in any way illegal, immoral or contrary to public order. Postings containing solely or largely advertising material are not permitted. You may provide a link to your site (or to another site) if the content of that site is relevant to your posting. STRATREAL reserves the right to monitor, edit or remove the content of the forum and message board, but does not regularly review such content. STRATREAL accepts no responsibility for the content of the forum and message board.

11) Data Protection and Privacy:

a) The information that STRATREAL gathers from you is used by it to ensure that it can give you the best possible service, to provide you with the information and services you request and for STRATREAL's own internal market analysis.

b) STRATREAL may disclose your information to its agents, advisors and service providers for these purposes, and may share your information with its group companies. STRATREAL may also disclose your personal information if we are required or permitted to do so by law or to fraud prevention agencies or registries to help them prevent fraud or to enforce the rights of STRATREAL or any of these Terms and Conditions.

c) Please ensure that you only enter your own details. If the information relates to another individual you must obtain the consent of that individual

d) STRATREAL or its group companies may contact you by email or post with publications, information regarding new transactions, forthcoming events or conferences which may be of interest to you. By providing us with your email and postal addresses and telephone number you consent to being contacted by email, post or telephone for these purposes.

12) Exclusions and Disclaimers:

a) STRATREAL makes no warranties except as set out in these terms and conditions and to the extent permitted by law all other express and implied warranties, terms and conditions are hereby excluded.

b) The Site content is only for your general information and use and is not intended to address your particular requirements. In particular the Site content does not constitute any form of advice, recommendation or arrangement by STRATREAL and is not intended to be relied upon by users in making (or refraining from making) any specific investment decisions. Appropriate advice should be obtained from one of STRATREAL's advisors before making any such decision The Site is intended to deal solely with investment in real estate and nothing in it is intended to constitute a financial promotion for the purposes of Section 21 of the Financial Services and Markets Act 2000.

c) You should be aware the investment in real estate can be speculative and involves a degree of risk and that the value of real estate can go down as well as up

d) The Global Real Estate [Opportunity] Wave provides an indication where urban markets are located within their medium-term prime office rental cycles. Each city tends to have its own cycle period and amplitude. As there are also secondary cycles within the broad major movement of the markets, cities may move backward as well as forward. The three cycles of the Wave are schematic representations which are to be treated with caution. The Wave does not permit comparison of the amplitude of the cycles in individual markets and does not show absolute growth rates. It only indicates a city's general position within its own cycle.

13) Limitation of Liability: To the extent permitted by law, STRATREAL does not accept any responsibility for any losses or damages whatsoever including, without limitation, direct, indirect, special or consequential loss or damage and/or loss of profits, business revenue, goodwill or anticipated savings arising out of access to or use of or reliance on or inability to access any information posted on the Site or any hypertext or hyperlink to a web site or any information contained on or accessed through such web site.

14) Entire Agreement: These terms and conditions contain the entire understanding between you and STRATREAL with regard to your use of the Site and no representation, statement or inducement, whether oral or written, not contained herein shall bind either you or STRATREAL. STRATREAL reserves the right to change these terms and conditions from time to time. Use of the Site is subject to the terms and conditions posted on the Site at the time of your visit. If you do not agree to any changes to the terms and conditions then you must immediately stop using the Site. Please continue to review these terms and conditions whenever accessing or using the Site.

15) Severability: Should any part of these terms and conditions for any reason be declared invalid by a court of competent jurisdiction, such determination shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of these terms and conditions had been eliminated.

16) Governing Law: These terms and conditions and your use of the Site are governed by English law. Disputes arising out of these terms and conditions shall be subject to the exclusive jurisdiction of the English courts.
